ORDINANCE 10-05

 

CALENDAR YEAR 2010

MODEL ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS

AND TO ESTABLISH A CAP BANK

(N.J.S.A. 40A: 4-45.14)

 

WHEREAS, the Local Government Cap Law, N.J.S. 40A: 4-45.1 et seq., provides that in the preparation of its annual budget, a municipality shall limit any increase in said budget to 0% unless authorized by ordinance to increase it to 3.5% over the previous year’s final appropriations, subject to certain exceptions; and,

 

WHEREAS, N.J.S.A. 40A: 4-45.15a provides that a municipality may, when authorized by ordinance, appropriate the difference between the amount of its actual final appropriation and the 3.5% percentage rate as an exception to its final appropriations in either of the next two succeeding years; and,

 

WHEREAS, the Borough Council of the Borough of Merchantville in the County of Camden finds it advisable and necessary to increase its CY 2010 budget by up to 3.5% over the previous year’s final appropriations, in the interest of promoting the health, safety and welfare of the citizens; and,

 

WHEREAS, the Borough Council hereby determines that a 3.5% increase in the budget for said year, amounting to $119,697.13 in excess of the increase in final appropriations otherwise permitted by the Local Government Cap Law, is advisable and necessary; and,

 

WHEREAS the Borough Council hereby determines that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years.

 

NOW THEREFORE BE IT ORDAINED, by the Borough Council of the Borough of Merchantville, in the County of Camden, a majority of the full authorized membership of this governing body affirmatively concurring, that, in the CY 2010 budget year, the final appropriations of the Borough of Merchantville shall, in accordance with this ordinance and N.J.S.A. 40A: 4-45.14, be increased by 3.5%, amounting to $119,697.13, and that the CY 2010 municipal budget for the Borough of Merchantville be approved and adopted in accordance with this ordinance; and,

 

BE IT FURTHER ORDAINED, that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years; and,

 

BE IT FURTHER ORDAINED, that a certified copy of this ordinance as introduced be filed with the Director of the Division of Local Government Services within 5 days of introduction; and,

 

BE IT FURTHER ORDAINED, that a certified copy of this ordinance upon adoption, with the recorded vote included thereon, be file with said Director within 5 days after such adoption.

The foregoing Ordinance was introduced by Mayor and Council at the regular meeting held on April 12, 2010.  This Ordinance will be considered for adoption on final reading and public hearing to be held on May 10, 2010 at 7:30 p.m. in the Council Meeting Room, Merchantville Borough Hall, 1 West Maple Avenue, Merchantville, New Jersey.

 

The purpose of this Ordinance is to exceed the Municipal budget appropriation limits and to establish a CAP Bank in the Borough of Merchantville.  A copy of this Ordinance is available at no charge to the general public between the hours of 8:30 AM to 4:30 PM, Monday through Friday (Legal Holidays excluded), at the Office of the Borough Clerk, Merchantville Borough Hall, 1 West Maple Avenue, Merchantville, New Jersey.

RESOLUTION AUTHORIZING ADVANCE PAYMENT TO

PATRICIA FIELDS FOR THE 2010 PARKS AND RECREATION PROGRAM

 

 

                   WHEREAS, N.J.S.A. 40A:5-16.1 permits the governing body of any local unit to authorize payment in advance toward expenses for authorized expenditures for Borough programs; and

 

                        WHEREAS, Patricia Fields of the Borough of Merchantville will need funds to purchase supplies for the Parks and Recreation Program scheduled from June 28, 2010 through July 30, 2010; and

 

                        WHEREAS, the Treasurer has certified that funds are available from the 2010 Recreation Commission budget, Recreation Commission Parks and Playgrounds, not to exceed $500.00 to provide advance expense payments; and

 

                        WHEREAS, the Borough will verify their expenses and any excess cash will be repaid to the Borough along with a detailed bill of items or demand, and the certification or affidavit required by N.J.S.A. 40A:5-16 shall be submitted within 10 days after the completion of the Parks and Recreation Program for which the advance was made.

 

                        NOW, THEREFORE, BE IT RESOLVED that the treasurer is hereby instructed to make the above said payment to Patricia Field for Parks and Recreation Program expenses.

RESOLUTION OF THE BOROUGH OF MERCHANTVILLE, COUNTY OF CAMDEN AND STATE OF NEW JERSEY AUTHORIZING CONTRACT FOR ALCOHOL AND DRUG ALLIANCE

 

 

 

WHEREAS, the Borough Council of the Borough of Merchantville,

 

            County of Camden, State of New Jersey recognizes that the abuse of alcohol

 

            and drugs is a serious problem in our society amongst persons of all ages; and

 

WHEREAS, the Borough Council further recognizes that it is incumbent upon

 

            not only public officials but upon the entire community to take action to prevent     

 

            such abuses in our community; and

 

WHEREAS, the Borough Council has applied for funding to the Governor’s

 

            Council on Alcoholism and Drug Abuse through the County of Camden;

 

NOW, THEREFORE, BE IT RESOLVED by the Borough of Merchantville,

 

            County of Camden, State of New Jersey hereby recognizes the following:

 

                        1. The Borough Council does hereby authorize submission of an

 

            application for the Merchantville Municipal Alliance grant for calendar year 2010

 

            in the amount of $8,713.00.             

 

                        2. The Borough Council acknowledges the terms and conditions for           

 

            administering the Municipal Alliance grant, including the administrative

            WHEREAS, the Borough would like to hire an administrator to oversee the Parks and Playgrounds Program;

RESOLUTION OF THE BOROUGH OF MERCHANTVILLE, COUNTY OF CAMDEN AND STATE OF NEW JERSEY RECOMMENDATION OF BOROUGH COUNCIL FOR 2010-2011 SCHOOL BUDGET OF THE BOARD OF EDUCATION

 

WHEREAS, the proposed 2010-2011 School Budget and separate proposal of the Board of Education of the Borough of Merchantville, County of Camden and State of New Jersey, were defeated at the annual election held on May 10, 2010; and

WHEREAS, pursuant to N.J.S.A. 18A:22-37, the Borough Council of the Borough of Merchantville has met and consulted with the Board of Education of the Borough of Merchantville at a meeting and desires to certify the amount deemed necessary to provide a through and efficient education; and

WHEREAS, it is the recommendation of the Borough Council of the Borough of Merchantville that certain revisions be made to the 2010-2011 School Budget of the Board of Education of the Borough of Merchantville; and

Hi Denise,

Thank you for your time on Friday. You were very helpful in explaining the process.

I'm part of an informal volleyball club that has been playing together for over 10 years. We're extremely passionate about beach volleyball and recently lost our court to redevelopment. We're not a league, just a group of guys who get together 2 to 3 times each week to play the game we love for a few hours. We're basically a beach volleyball version of a book club.

Your town has a sand volleyball court (near Somerset Ave. and Prospect
St.) where we have played a handful of times over the past year. While it's in a great location, the court could use a renovation. It has the potential to be a truly beautiful place to play for the community.

My volleyball group would like to adopt your sand court. We own and would donate a professional net system and boundary lines. The existing poles are fine, but we would raise the hooks when installing the new system bringing the net to regulation height (8 feet as per FIVB and AVP rules).

The court needs additional sand to raise the quality of the playing surface and more closely mimic the feel of a natural beach. An additional
6 inches of beach sand (approximately 125 tons) would cost around $3,800 delivered. Not only would our club donate some money towards the purchase of the sand, we would be willing to donate our time to spread it all, saving the town any additional expenses in labor.

 Merchantville, NJ                January 25, 2010

           

            A regular meeting of Borough Council was held at 7:30 PM, Monday, January 25, 2010. Council president Anthony Perno presided.  Pledge of Allegiance and Silent Prayer were observed.  Announcement was made that the meeting had been advertised in accordance with the regulations prescribed by the “Open Public Meetings Act”.

 

ROLL CALL:

Council Present: Alloway, Brennan, Brunton, Brickley, Perno, Fields, Clerk Brouse, CFO Moules and Attorney Higgins.

 

PUBLIC

Gail Ford, 135 Centre Street-Questions regarding the Fieldstone agreement and appraisal, several issues concerning Cuzzupe property. Mr. Perno responded to Mrs. Ford’s questions in detail. Mr. Brunton made a statement regarding Mrs. Ford’s questions. Mrs. Moules responded to Mrs. Ford’s questions.

James Tugya, 58 W. Walnut Avenue Thanked the police for their quick response, would like Council to consider speed hump.

Mike Iannucci, 62 W. Walnut Avenue– had Leaf collection concerns. Mr. Brickley stated that grass seed will be replaced on grass strip.

Walter Werner, 110 Hamilton Avenue When will the leaves that are still on the ground be addressed? Concerned about the Resolution in West End naming a redevelopment area. What will the Borough be doing, will they take homes? Mr. Perno replied that there are no plans to absorb the homes in this area. When will the recommendation be ready? Planning Board President, Patrick Brennan responded that they are working on upgrading 606 W Maple Avenue and adding parking. No homes are being considered. Discussion continued on several issues.

RESOLUTION OF THE BOROUGH OF MERCHANTVILLE, COUNTY OF CAMDEN

AND STATE OF NEW JERSEY AUTHORIZING ENGINEER TO PREPARE BID

DOCUMENTS AND TO ADVERTISE FOR THE OPENING OF BIDS FOR THE

CHESTNUT AVENUE MULITPLE USE PATH

 

 

            WHEREAS, the New Jersey Department of Transportation has allotted $150,000.00 for the Chestnut Avenue Multiple Use Path Project; and

            WHEREAS, in accordance with Federal guidelines, this project much be advertised for bid within 60 days of receipt of final approval; and

            WHEREAS, the Governing Body desires to have the Multiple use path improvements, for the approximate cost of the New Jersey Department of Transportation funds, to be      performed by a contractor; and

            WHEREAS, it is necessary for the Borough Engineer to perform the necessary professional services to prepare the bid documents for the improvements; and

            WHEREAS, once the bid documents have been prepared by the Engineer and accepted by the New Jersey Department of Transportation and the Federal Highway Administration, the Borough Clerk must be authorized to advertise for and open bids for the project; and

            NOW, THEREFORE BE IT RESOLVED, by the Mayor and Council of the Borough of Merchantville, in the County of Camden, State of New Jersey, hereby authorize the Borough Engineer to prepare the bid documents and the Clerk to advertise and receive       bids for this project.

RESOLUTION OF THE BOROUGH OF MERCHANTVILLE, COUNTY OF

CAMDEN, STATE OF NEW JERSEY AWARDING A CONTRACT TO COMPLETE

SANITARY SEWER LINE AND MANHOLE REHABILITATION PROJECT

 

            WHEREAS, the Borough Council of the Borough of Merchantville is desirous of completing the Sanitary Sewer line and Manhole Rehabilitation Project  for the New Jersey

Environmental Infrastructure Financing Program ; and

            WHEREAS, bids have been solicited and received for this project; and

            WHEREAS, the Chief Financial Officer has certified as to the availability of funds;

            NOW, THEREFORE, BE IT RESOLVED, that the contract is awarded to Allstate Power Vac, Inc. 928 E. Hazelwood Avenue, Rahway, NJ 07065, in an amount not to exceed $1,575,000.

RESOLUTION OF THE BOROUGH OF MERCHANTVILLE,

COUNTY OF CAMDEN AND STATE OF NEW JERSEY TO REQUEST

FOR BID OF TEMPORARY LABOR FOR PUBIC WORKS DEPARTMENT

 

            WHEREAS, the Mayor and Council of the Borough of Merchantville desire to go out to

bid for temporary labor services for the Department of Public Works; and

            WHEREAS, this resolution will be effective for the first quarter of 2010 due to the temporary budget; and

            WHEREAS, the total expense for temporary labor services for the 2010 year will not exceed $5,000.00;

             NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Merchantville, County of Camden, State of New Jersey, that Denise Brouse, Borough Clerk of the Borough of Merchantville, be and hereby is authorized to requests bids for temporary labor services  known as attachment “A” for the Borough of Merchantville Department of Public Works.

RESOLUTION OF THE BOROUGH OF MERCHANTVILLE, COUNTY OF CAMDEN

AND STATE OF NEW JERSEY AUTHORIZING PERSON TO PERSON TRANSFER

 OF ALCOHOLIC BEVERAGE LICENSE

 

            WHEREAS, the application filed for a person-to-person transfer of Plenary Retail

Consumption License No. 0424-44-001, was issued to Manish Kandar from Shivani Beverage by

Resolution R09-136 for the premises located at 620 West Maple Avenue, Merchantville, NJ; and

            WHEREAS, the submitted application and the settlement of the property was not completed and the tax clearance was not issued to Manish Kandar; and

            WHEREAS, Shivani is qualified to be licensed according to all standards established by

Title 33 of the New Jersey Statutes, regulations promulgated thereunder, as well as pertinent local ordinances and conditions consistent with Title 33; and

            NOW, THEREFORE, BE IT RESOLVED that the Borough of Merchantville does hereby approve, effective January 25, 2010, the transfer of the aforesaid Plenary Retail Consumption License to Shivani Beverage Corporation, and does hereby direct the Municipal Clerk to endorse the license certificate back to the original ownership as follows: “This license, subject to all its terms and conditions, is hereby transferred to, Shivani Beverage Corporation effective January 25, 2010.

COUNTY OF CAMDEN AND STATE OF NEW JERSEY FOR

REFUND OF TAX SALE PAYMENT TO LIEN HOLDER

 

          WHEREAS, the Merchantville Tax Collector has called to Mayor and Council’s attention a request to refund a Tax Sale payment to the Lien Holder because the homeowner is in Bankruptcy and should not have gone to Tax Sale:

          NOW, THEREFORE, be it resolved by the Mayor and Council of the Borough

Marge Disch, 23 E. Chestnut Street, found home for the ship wheel at the Museum.

 

Woschenko, 8 Morris Street, was it discussed in council regarding merge? A council person discussed forming a committee. The Borough is not giving up and not interested in merge. Reviewed budget items and only see a small short fall for 2009.

 

Tom Evaul, 125 St. James Avenue, do we have a signed agreement with Fieldstone. Have we bought all the properties? We are in negotiation for last property.

 

ENGINEER’S REPORT:

The Engineer provided a written report on ongoing projects.

COUNCIL REPORTS:

Mrs. Fields-Personal manual with JIF updates should be ready. New playground equipment should be installed by end of week. Planning Board did not meet last month. Abandoned properties court papers were filed.  NPP reported that all funds are allocated.   Four applications were taken this month. Letters have been sent to the Assemblymen.

 

Mr. Brickley reported on Public Works, preventative maintenance issues continue and we are working on repairs. Pennsauken loaned Merchantville a trash truck.  Grass cut for opening day at baseball.  We will purchase equipment for lawn work.

 

Mr. Brunton gave the Shade Tree report. Merchantville Public Works will donate a tree for Arbor Day, April 30th. Meeting will be on Wednesday at Library.  Office of Emergency Management meeting is delayed.

 

Mr. Brennan reported that website will be working on May 1st or so. Public Events meeting 6:30-7:00. June 5th is the Birthday celebration. Egg Hunt went well. Thanks to the Easter Bunny, Dawn Schmidt and Steve Volkert. Reduction for Court dates from four per month to two is being considered.

 

Mr. Alloway-Police had 227 calls for service, 3 DWI, Pedestrian crossing checkpoint, 30 summons at Chestnut and Browning. Grant application for Click it or Ticket. Loitering problems in West End & Community Center (skateboarding). Purchase a sign stating no skate boarding at community center. Police will step up patrols.

Discussion- Ship Wheel at Community Center

A museum is interested in leasing the ship wheel.  Discussion took place and it was decided that the museum would prepare an agreement to borrow the wheel for a period of five years.

 

NEW BUSINESS:

 

ORDINANCE INTRODUCTION-On a motion of Mr. Brickley and second of Mr. Brennan, (with Mr. Brunton voting no) council approved the introduction of the following Ordinance:

 

ORDINANCE 10-05

CALENDAR YEAR 2010 MODEL ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS

AND TO ESTABLISH A CAP BANK

(N.J.S.A. 40A: 4-45.14)

 

            WHEREAS, the Local Government Cap Law, N.J.S. 40A: 4-45.1 et seq., provides that in the preparation of its annual budget, a municipality shall limit any increase in said budget to 0% unless authorized by ordinance to increase it to 3.5% over the previous year’s final appropriations, subject to certain exceptions; and,

            WHEREAS, N.J.S.A. 40A: 4-45.15a provides that a municipality may, when authorized by ordinance, appropriate the difference between the amount of its actual final appropriation and the 3.5% percentage rate as an exception to its final appropriations in either of the next two succeeding years; and,

            WHEREAS, the Borough Council of the Borough of Merchantville in the County of Camden finds it advisable and necessary to increase its CY 2010 budget by up to 3.5% over the previous year’s final appropriations, in the interest of promoting the health, safety and welfare of the citizens; and,

            WHEREAS, the Borough Council hereby determines that a 3.5% increase in the budget for said year, amounting to $119,697.13 in excess of the increase in final appropriations otherwise permitted by the Local Government Cap Law, is advisable and necessary; and,

            WHEREAS the Borough Council hereby determines that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years.

            NOW THEREFORE BE IT ORDAINED, by the Borough Council of the Borough of Merchantville, in the County of Camden, a majority of the full authorized membership of this governing body affirmatively concurring, that, in the CY 2010 budget year, the final appropriations of the Borough of Merchantville shall, in accordance with this ordinance and N.J.S.A. 40A: 4-45.14, be increased by 3.5%, amounting to $119,697.13, and that the CY 2010 municipal budget for the Borough of Merchantville be approved and adopted in accordance with this ordinance; and,

            BE IT FURTHER ORDAINED, that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years; and,

            BE IT FURTHER ORDAINED, that a certified copy of this ordinance as introduced be filed with the Director of the Division of Local Government Services within 5 days of introduction; and,

            BE IT FURTHER ORDAINED, that a certified copy of this ordinance upon adoption, with the recorded vote included thereon, be file with said Director within 5 days after such adoption.

 

RESOLUTION 10-44 CALCULATION OF RESERVE FOR UNCOLLECTED TAXES: On a motion of Mr. Brennan and second of Mrs. Fields, Council approved the following resolution:

BOROUGH OF MERCHANTVILLECOUNTY OF CAMDENRESOLUTION TO UTILIZE AVERAGE TAX COLLECTION RATEFOR CALCULATION OF RESERVE FOR

UNCOLLECTED TAXES APPROPRIATION IN THE 2010 MUNICIPAL BUDGET

 

            WHEREAS, the Borough of Merchantville Borough has experienced a decline in tax collection rates in the last two years; and

            WHEREAS, the use of the lower collection rate in arriving at the budget appropriation Reserve for Uncollected Taxes in the 2010 Municipal Budget would result in an unfair tax burden to the taxpayers of the Borough of Merchantville; and

            WHEREAS, the Division of Local Government Services, Department of Community Affairs will allow the Borough of Merchantville to use the average of the prior three years’ collection rates in calculating the budget appropriation Reserve for Uncollected Taxes in the 2010 Municipal Budget; and

            WHEREAS, the prior three years’ collection rates are 96.46% for 2007, 94.40% for 2008 and 94.61% for 2009; and

            WHEREAS, the averaging of the prior three years’ collection rates result in a collection rate of 95.15%;

            NOW, THEREFORE, BE IT RESOLVED that the Borough of Merchantville will use the collection rate of 95.00% in calculating the budget appropriation Reserve for Uncollected Taxes in the 2010 Municipal Budget.

 

RESOLUTION 10-45 AUTHORIZATION OF TEMPORARY EMERGENCY APPROPRIATIONS: On a motion of Mr. Brennan and second of Mr. Alloway, Council approved the following resolution:

 AUTHORIZING TEMPORARY EMERGENCY APPROPRIATIONS

 

            WHEREAS, adoption of the 2010 Municipal Budget has been delayed; and

            WHEREAS, no provision was made in the 2010 Temporary Budget for budget appropriations beyond March 31, 2010; and

            WHEREAS, NJSA 40A:4-20 provides for the creation of an emergency temporary appropriation for operating expenditures when the adoption of the Municipal Budget has been delayed; and

            WHEREAS, the total emergency operating expenditures for the second quarter of 2010 are expected to be $ 1,042,461.91 for the Current Fund and $ 91,627.86 for the Sewer Fund;

 

            NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Merchantville in accordance with the provisions of NJSA 40A:4-20 that:

An emergency temporary appropriation in the amount of $1, 042,461.91 for the Current Fund and $ 91,627.86 for the Sewer Fund is hereby made.

That said emergency temporary appropriations have been provided for in the 2010 Municipal Budget.

RESOLUTION OF THE BOROUGH OF MERCHANTVILLE, COUNTY OF CAMDEN, NEW JERSEY AUTHORIZING THE FILING FOR A 2010 RECYCLING TONNAGE GRANT

 

WHEREAS, the Mandatory Source Separation and Recycling Act, P.L. 1987, c. 102 has established a recycling fund from which a tonnage grant may be made to municipalities in order to encourage local source separation and recycling programs; and

WHEREAS, it is the intent and spirit of the Mandatory Source Separation and Recycling Act to use the tonnage grants to develop new municipal recycling programs and to continue and to expand existing programs; and

WHEREAS, the New Jersey Department of Environmental Protection has promulgated recycling regulations to implement the Mandatory Source Separation and Recycling Act; and

WHEREAS, the recycling regulations impose on municipalities certain requirements as a condition for applying for tonnage grants, including but not limited to, making and keeping accurate, verifiable records of materials collected and claimed by the municipality; and

WHEREAS, a resolution authorizing this municipality to apply for such tonnage grants for 2007 will memorialize the commitment of this municipality to recycling and to indicate the assent of the Borough Council of the Borough of Merchantville to the efforts undertaken by the municipality and the requirements contained in the Recycling Act and recycling regulations; and

WHEREAS, such a resolution should designate the individual authorized to ensure the application is properly completed and timely filed.

NOW, THEREFORE, BE IT RESOLVED, by the Borough Council of the Borough of Merchantville that the Borough of Merchantville hereby endorses the submission of the recycling tonnage grant application to the New Jersey Department of Environmental Protection; and

BE IT FURTHER RESOLVED that the monies received from the recycling tonnage grant be deposited in a dedicated recycling trust fund to be used solely for the purposes of recycling.

RESOLUTION OF THE BOROUGH OF MERCHANTVILLE,

COUNTY OF CAMDEN AND STATE OF NEW JERSEY LOCAL UNIT CIVIL RIGHTS RESOLUTION TO AFFIRM THE BOROUGH OF MERCHANTVILLE’S CIVIL RIGHTS POLICY WITH RESPECT TO ALL OFFICIALS, APPOINTEES, EMPLOYEES, PROSPECTIVE EMPLOYEES, VOLUNTEERS, INDEPENDENT CONTRACTORS, AND MEMBERS OF THE PUBLIC THAT COME INTO CONTACT WITH  MUNICIPAL EMPLOYEES, OFFICIALS AND VOLUNTEERS

 

WHEREAS, it is the policy of the Borough of Merchantville to treat the public, employees, prospective employees, appointees, volunteers and contractors in a manner consistent with all applicable civil rights laws and regulations including, but not limited to the Federal Civil Rights Act of 1964 as subsequently amended, the New Jersey law against Discrimination, the Americans with Disabilities Act and the Conscientious Employee Protection Act, and

            WHEREAS, the governing body of the Borough of Merchantville has determined that certain procedures need to be established to accomplish this policy.

            NOW, THEREFORE BE IT ADOPTED by the Borough of Merchantville that:

Section 1: No official, employee, appointee or volunteer of the Borough of Merchantville by whatever title known, or any entity that is in any way a part of the Borough of Merchantville shall engage, either directly or indirectly in any act including the failure to act that constitutes discrimination, harassment or a violation of any person’s constitutional rights while such official, employee, appointee, volunteer, or entity is engaged in or acting on behalf of the Borough of Merchantville’s business or using the facilities or property of the Borough of Merchantville.

Section 2: The prohibitions and requirements of this resolution shall extend to any person or entity, including but not limited to any volunteer organization or inter-local organization, whether structured as a governmental entity or a private entity, that receives authorization or support in any way from the Borough of Merchantville to provide services that otherwise could be performed by the Borough of Merchantville.

Section 3: Discrimination, harassment and civil rights shall be defined for purposes of this resolution using the latest definitions contained in the applicable Federal and State laws concerning discrimination, harassment and civil rights.

Section 4: The Mayor shall establish written procedures for any person to report alleged discrimination, harassment and violations of civil rights prohibited by this resolution. Such procedures shall include alternate ways to report a complaint so that the person making the complaint need not communicate with the alleged violator in the event the alleged violator would be the normal contact for such complaints.

Section 5: No person shall retaliate against any person who reports any alleged discrimination, harassment or violation of civil rights, provided however, that any person who reports alleged violations in bad faith shall be subject to appropriate discipline.

Section 6: The Mayor shall establish written procedures that require all officials, employees, appointees and volunteers of the Borough of Merchantville as well as all other entities subject to this resolution to periodically complete training concerning their duties, responsibilities and rights pursuant to this resolution.

Section 7: The Mayor shall establish a system to monitor compliance and shall report at least annually to the governing body the results of the monitoring.

Section 8: At least annually, the Mayor shall cause a summary of this resolution and the procedures established pursuant to this resolution to be communicated within the Borough of Merchantville.  This communication shall include a statement from the governing body expressing its unequivocal commitment to enforce this resolution. This summary shall also be posted on the Borough of Merchantville’s web site.

Section 9: This resolution shall take effect immediately.

Section 10: A copy of this resolution shall be published in the official newspaper of the Borough of Merchantville in order for the public to be made aware of this policy and the Borough of Merchantville’s commitment to the implementation and enforcement of this policy.
